These Terms and Conditions (hereinafter referred to as the “T&C”) govern the use of the online platform Studycraft.

§1 Provider and Scope of Application

These T&C govern the use of the online platform Studycraft.

Provider Information

  • Provider within the meaning of Section 5 of the Austrian E-Commerce Act (ECG): Oleksandr Kuzhel (Sole Proprietor)
  • Member of the Austrian Economic Chamber (WKO)
  • GISA Number: 39076816
  • Registered office: Austria (hereinafter “Studycraft”)

These T&C apply to all users of the platform, in particular students and creators.

§2 Definitions

Unless expressly stated otherwise in these T&C, the following definitions apply:

“Platform”

The online marketplace platform operated by Studycraft, including all technical functions, course areas, and digital systems.

“User”

Any natural or legal person who uses the platform, regardless of whether acting as a student or creator.

“Student”

A user who accesses or purchases online courses or other educational services via the platform.

“Creator”

A user who independently creates, offers, and distributes online courses or educational content via the platform.

“Materials”

All content created, provided, or uploaded by a creator, including in particular texts, textbooks, worksheets, graphics, presentations, videos, audio files, animations, scripts, digital assets, interactive content, recordings of teaching sessions, and any other works within the meaning of the Austrian Copyright Act (UrhG).

“Use”

Any form of accessing, viewing, storing, transmitting, embedding, processing, or otherwise handling materials.

“Online Courses”

Digital educational offerings independently created and provided by creators via the platform, regardless of whether they are live, recorded, or supervised.

“Course Area”

A technically protected area of the platform accessible exclusively to authorized students

“Payment Service Provider”

The external payment service provider Stripe, through which all payment and payout transactions are processed.

§3 Eligibility

Use of the platform is permitted only to persons who have legal capacity under the applicable law.

Within the European Union, this generally requires a minimum age of 18 years.

By using the platform, the user confirms that these requirements are met.

§4 Registration and User Account

  • Registration is required to use certain platform features.
  • Users are required to provide complete and truthful information.
  • Login credentials must be kept confidential. The transfer or sharing of user accounts is prohibited.
  • Users are responsible for all activities carried out via their user account.

§5 Role of Studycraft as an Intermediary Platform

Studycraft provides solely the technical infrastructure of an online marketplace.

Contracts for online courses are concluded exclusively between the student and the creator.

Studycraft is neither an employer, agent, tax advisor, nor contractual partner of the creators.

§6 Obligations and Responsibility of Creators

Creators act independently and on their own responsibility.

Creators are solely responsible for their content, materials, and services.

By publishing materials, the creator represents and warrants that all necessary rights are held, that no third-party rights are infringed, and that the content is lawful.

Studycraft is not obliged to review content in advance but reserves the right to remove or restrict content at any time.

§7 Payment Processing, Commission, and Taxes

Payment processing is carried out exclusively via Stripe.

Creators are required to connect their own Stripe Connect account.

Studycraft charges a platform commission of 20% of the sales price, which is deducted from the creator’s share.

In the event of refunds or partial refunds, the platform commission is not refunded to the creator.

Creators are solely responsible for all tax obligations. Studycraft does not provide tax advice and assumes no tax-related liability.

§8 Refunds and Right of Withdrawal

Refunds are processed in accordance with applicable EU consumer protection regulations and Studycraft’s internal policies.

The right of withdrawal for digital content expires pursuant to Section 18(1)(11) of the Austrian Distance and Off-Premises Contracts Act (FAGG) once the student has expressly consented to the commencement of contract performance before the expiry of the withdrawal period and access to the content has begun.

§9 Intellectual Property and Rights of Use

  • Copyright in the materials remains with the respective creator.
  • Students receive a simple, non-transferable right of use exclusively for private purposes.
  • Reproduction, distribution, recording, or resale of materials is prohibited.
  • Studycraft is entitled to use content or excerpts thereof for presentation and marketing purposes.

§10 Suspension and Termination

  • Studycraft is entitled to suspend or delete content or user accounts in the event of violations of these T&C or applicable law.
  • In cases of serious violations, Studycraft may withhold payouts and permanently exclude users from the platform.

§11 Limitation of Liability

Studycraft is liable only in cases of intent or gross negligence, to the extent permitted by law.

The platform is provided “as is.” No guarantee is given regarding availability, error-free operation, or specific results.

To the extent permitted by law, Studycraft assumes no liability for: content, materials, or services provided by creators; the academic or didactic quality of online courses; students’ learning outcomes, examination results, or academic success; or decisions made by students based on course content.

Liability for lost profits and indirect damages is excluded.

§12 Final Provisions

Studycraft reserves the right to amend these T&C at any time. Continued use of the platform constitutes acceptance of the amended terms.

Austrian law shall apply. Mandatory consumer protection provisions remain unaffected.

Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.


In case of any ambiguity or inconsistency between the German version of this document and its translations, the German version shall be authoritative and prevail for all legal purposes.
